Acceptance of Terms
By accessing and using gen-image, you agree to comply with and be bound by the following terms and conditions of use. Please review these terms carefully. If you do not agree to these terms, you should not use this service.
Description of Service
Gen-image provides an AI powered image generation service. The service is offered free of charge. No subscription or payment is required for access to the service. Users may subscribe to access more advanced features and generation credits. All type of users can also purchase generation credits.
No Service Level Agreement (SLA)
The service is provided “as is” without any guarantees or warranty. In association with the product, Publikey Sàrl makes no warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, of title, or of non-infringement of third party rights. Use of the service by a user is at the user’s risk.
Acceptable Use of Generative AI
Gen-image is provided as a general-purpose AI image generation service. Users agree to use the service responsibly and in compliance with all applicable laws and regulations.
Prohibited Uses
Users must not use the service to generate, upload, distribute, or otherwise create content that includes:
- Pornographic, sexually explicit, or adult material, including nudity or sexual acts
- Sexual content involving minors (zero tolerance)
- Content that is illegal, exploitative, or abusive
- Hate, harassment, or violent content
- Content that infringes intellectual property or privacy rights
- Any material intended to mislead, defraud, or impersonate others
This list is non-exhaustive.
User Responsibility
Users are solely responsible for all content they generate or use through the service.
Gen-image does not implement systematic automated or manual moderation of generated content. Compliance relies on user responsibility.
Publikey Sàrl assumes no liability for content produced by users.
Enforcement
Any violation of this Acceptable Use policy constitutes a material breach of these Terms.
Publikey Sàrl reserves the right, at its sole discretion, to suspend or permanently terminate user access immediately and without notice if prohibited use is detected or suspected.
Publikey Sàrl has no obligation to monitor content but reserves the right to investigate abuse and take appropriate action.
Modification of Terms and Conditions
Publikey Sàrl reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the service after any such changes shall constitute your consent to such changes.
Limitation of Liability
In no event shall Publikey Sàrl be liable for any indirect, special, incidental, consequential, or exemplary damages arising from your use of or inability to use the services and software. This limitation shall apply whether or not Publikey Sàrl has been informed of the possibility of such damage.
Governing Law
These Terms and Conditions are governed by the laws of Switzerland. Any disputes relating to these terms and conditions will be subject to the Geneva, Switzerland courts.
